The Court Fees (Miscellaneous Amendments) Order 2021 has been published and comes into force on 30 September 2021. As a result, certain court fees will be increased in line with inflation backdated to 2016, as this was the last time most fees were increased, and sees Court fees increasing by around 8%. The income threshold for receiving help with fees is also set to increase.
Over 100 court fees will increase with some of the major ones regarding Family Proceedings being:
- the fee for issuing a divorce will rise to £593 from £550
- a Children Act application will rise to £232 from £215
- Financial Remedy will rise to £275 from £255
Unfortunately, these fee increases are going to add to the costs of resolving issues through the court. Anyone contemplating divorce or other court proceedings may wish to take action now before the fees rise as some courts applications are unavoidable e.g. it is only possible to get divorced if an application is made to the court, and even if an agreement can be reached concerning financial issues the only way to ensure they are final is to have a consent order.
