Employment Discrimination Solicitors who are on your side

The law seeks to provide a level playing field at work so that people are employed, paid, trained and promoted only because of their skills and performance. There is no minimum length of employment requirement for a discrimination claim and protection starts from when a role is advertised through to the last day of employment and beyond, including references.

Our employment discrimination solicitors will provide you with guidance and advice on the steps to take when faced with discrimination at work. This includes assisting you in raising the issue at work, both informally and formally, through the company grievance procedure. We will also represent you in a claim to the employment tribunal, in the event that your employer fails to take the necessary steps to resolve the discrimination issues.

FAQs

What are the characteristics an employer cannot use to discriminate against me?

Employment discrimination at work can be direct or indirect but whatever form it takes, it should not happen regardless of if you work part-time, are on a fixed-term contract, or large or small your employer is. Under the law there are 9 protected characteristics, and discrimination occurs when you’re treated unfairly because of:

  • age
  • disability
  • gender reassignment
  • marriage and civil partnership
  • pregnancy and maternity
  • race or colour
  • religion or belief
  • sex
  • sexual orientation
What forms can discrimination take at work?

The Equality Act 2010 sets out four main types of discrimination:

  • Direct Discrimination: This is discrimination against an employee because of one or more of the protected characteristics named above.
  • Indirect Discrimination: This is where a policy or practice in the workplace causes a considerably smaller proportion of those with a protected characteristic to be unable to comply with the policy or practice than those who do not have the protected characteristic or who have a different protected characteristic.
  • Victimisation: This is where an employee is treated less favourably because they have or might complain about discrimination or support someone else’s complaint about discrimination.
  • Harassment: This is when an employee is subjected to unwanted verbal, non-verbal or physical conduct related to a protected characteristic which violates their dignity or creates an intimidating, hostile, degrading, humiliating or offensive environment. It can include behaviour that individuals find offensive even if it’s not directed at them, and even if they do not have the relevant protected characteristic themselves.
What can I do if I feel my employer is discriminating against me?

If you believe your employer is discriminating against you, you can first raise the issue informally with your employer, and if the matter is not resolved or you feel the situation is too serious to be resolved informally, you should make your complaint formally through the employer’s grievance procedure. Your employer should take your discrimination complaint seriously and look into it as soon as possible.

If that doesn’t resolve the problem, you must start ACAS early conciliation within three months minus one day of the discriminatory act. If conciliation fails, you can then make a claim to the Employment Tribunal. Throughout this process, it’s vital to keep a detailed record of incidents, dates, and evidence, such as emails or witness details.

Why you should get legal advice before signing an Employment Contract
An employment contract review by a solicitor can help you understand your rights, identify unfair or risky terms, and negotiate stronger protections before problems arise.
What is the difference between an offer of Redundancy and a Settlement Agreement?
While redundancy and settlement agreements can overlap, they are fundamentally different. If your employer has offered you a settlement agreement as an alternative to redundancy, you should carefully consider which route to take, as each has different financial, professional, and legal consequences.
