What will your solicitors do to help me resolve a contractual dispute?

Contract dispute solicitors usually play a crucial role in managing and resolving disputes between parties involved in various contractual agreements. Whilst our actions will depend on the circumstances of the case, in essence our contract dispute solicitors will:

  • Review the contract involved to help interpret the rights and obligations. We’ll highlight any discrepancies or ambiguity to reduce liability and protect your rights Once we have the facts, we can advise our clients on whether they have a strong case to make a claim or suggest other alternative resolution methods like negotiation or arbitration.
  • We will also make a proactive risk assessment on any possible future issues we might see in the contract that could lead to disputes further down the line and suggest modifications or updates to the contract/s to avoid them.
  • We will try and diffuse tensions by conducting the negotiation and mediation between parties to reach a fair and favourable settlement without going to court.
  • If a contract dispute is unresolved after mediation, our solicitors can advise on the appropriate court, prepare legal documents, presenting evidence, and argue on our client’s behalf to seek a favourable judgment.
What are common disputes over contracts?

Contractual disputes normally arise when one party does not comply with the terms of a contract or does not perform their obligations giving rise to a claim for breach of contract. Parties may disagree over

  • what was intended
  • what a particular clause means
  • whether a party has performed their contractual obligations to the required standard
  • disputes over delivery and quality
  • failure to pay sums due under the contract as they fall due
  • termination of the agreement and the potential consequences if this is not done correctly
What amounts to a Breach of contract?

A breach of contract is where one party fails to fulfil their commitments under a lawful agreement. There are two main types of contract breaches;

  • Material breach: This is a serious infringement of the contract that significantly interferes with the contract’s purpose. It allows the innocent party to terminate the contract and claim damages for any losses suffered. For example, a supplier fails to deliver machinery or key materials by a specific date, causing a contractor to miss essential deadlines.
  • Minor breach: These are less serious offences that do not necessarily allow the innocent party to end the contract. Instead, they can usually seek damages or compensation for any losses e.g. caused by the delay of a delivery.
